Falls, Slips & Trips Kirkby
Whether you’ve sustained an injury in a public setting, work, shopping or anywhere else, if it was as a result of negligence from another, you may have grounds to claim compensation.
From time to time, we all slip, fall or trip for several reasons and in different circumstances. Uneven pavements, potholes, slippery flooring, spillages are all situations that can lead to severe injuries affecting both your mental and physical health.
At Wafer Phillips, we have years of experience in helping our clients throughout Kirkby win substantial financial compensation. Our extensive network of medical professionals can assess your injury whilst our team of solicitors work hard on your behalf to ensure that you aren’t out of pocket as a result of someone else’s negligence.
Falls, Slips and Trips Compensation
It is important to be aware of the complexity of Fall, Slips and Trips cases, as there are many technical defenses that may be impossible to breach. Every case has different circumstances and facts which is why our team will be more than happy to discuss with you, free of charge. Naturally, as emotions run high, the individuals we speak to believe that the seriousness of the accident is the biggest issue, but this is incorrect. Regardless of the severity of your injuries and whether it has affected your personal or work life, it holds no relevance in winning or losing the case. This does not grant compensation as there is implicit protection afforded to local authorities that operate as a public service. It, therefore, makes the case much more difficult to win, but not impossible.
Since 2012 there have been several drastic changes to the legal system which have fixed costs of what we are entitled to for our work and this cost is extremely low. Therefore, we are now forced, along with other solicitors, to deduct part of your compensation as payment for our costs which is currently set at 25%. This is naturally an incentive for us to win your case as we operate as a no win no fee firm.
Before 2012, if a case was taken to Court and lost the defendant’s costs would have to be paid by the loser, either you or us. However, since the introduction of Qualified One-Way Costs Shifting (QOCS) if a case proceeds to trial and is lost there is no responsibility on you or us to pay the opposition’s costs but there is one significant exception to this rule which is that if the Court decides, however, that if you have behaved fraudulently the protection is removed and you will be personally liable to pay the opposition’s fees. The Government are keen to stop what it sees as widespread fraud and deception (the actual reality is another matter) regarding car crash claims and it is because of this perception that changes have been made and continue to be made to the legal system.
